  The Donation of Embryos
 
  A new option for the financially and/or emotionally strained couple or individual is Embryo Donation.

Although some groups have taken an “adoption” approach to the donation of embryos, as has been thoroughly discussed on both Night Line with Ted Koppel and in the LA Times, our office has consistently chosen to handle these donations as just that, donations. This, of course, is entirely due to the current status of the law throughout the United States whereby the Courts have ruled that a dispute regarding embryos shall be treated as a “property” dispute, versus a custody battle between parents.

Essentially, embryo donation has become a viable method for many to create their families. These embryos are predominantly those created from donor sperm and donor egg, yet some are actually biologically related to their donors. In either situation, recipients are given the full medical history and physical characteristics of both genetic donors so that they are aware of all aspects of the embryos. The donation itself can be anonymous or open, depending upon the needs and desires of the donors and recipients involved.

 
 

Furthermore, we have consistently advised clients not to request any compensation for their embryos outside of possible reimbursement for storage fees up to some “reasonable” reimbursement for IVF costs. This donation should never be seen as a way to recoup all costs.
